Powers of Attorney

Power of Attorney is where a citizen (PROXY) or institution entrusts another citizen (PLAINTIFF) or institution to represent him before any civil act that may require before the institutions of the Dominican Republic or another country.

REQUIREMENTS:

  1. Identity Documents of the PROXY (Current ID, Passport, Driver's License).
  2. Identity Documents of the PROXY (ID card, Passport, Driver's License).
  3. Draft of the POWER OF ATTORNEY (with the information as specific as possible of the object of the representation, that is to say all those actions that the PROXY requires that the PLAINTIFF performs on behalf of the PROXY). NOTARIZED BY A NOTARY NEAR THE RESIDENCE OF THE PURCHASER IN CASE OF NOT SUBMITTING THE PERMIT TO OUR HEADQUARTERS.
  4. Document that demonstrates that the POWER OF ATTORNEY has the legal capacity to ask the PLAINTIFF to do something in his /her name in relation to any property, whether furnishing or state (title deed, bank account, financial certificate, etc.)

Special Power of Attorney

  1. Original power of attorney (in Spanish language) signed by the beneficiary before a Notary Public of the place where the power is subscribed, and legalized before the Attorney General's Office.
  2. Include the Signatories Generals.
  3. Specify the benefit you are requesting:
    1. Late Income by any of the following modalities: Pension for Life Annuity, Programmed Withdrawal or Return of Funds.
    2. Survival
    3. Disability.
    4. Terminal disease
    5. Old age.
  4. Include place and date of subscription of the Power of Attorney. The date and place must coincide with the legalization of the Notary Public.
  5. Subscribe in the presence of two (2) witnesses, including their generals. Witnesses may not be relatives of the Plaintiff, Proxy, or the Notary Public. (*)
  6. The signatures of the Proxy, Plaintiff and witnesses, must be the same as that contained in the identity document of each person, and subscribe in blue ink.
  7. In the event that the Proxy cannot sign for his or her health condition, he or she must state their fingerprints. Said condition must be recorded in the power of attorney and attach an original medical certificate.
  8. The Power of Attorney must not have errors, cross-outs, modifications, omissions or side notes.
  9. Todo poder suscrito fuera de la Republica Dominicana, debe estar apostillado conforme la Convención de La Haya o legalizado en Consulado Dominicano y certificado en el Ministerio de Relaciones Exteriores (Cancillería). (Verificar procedimiento del país donde se suscribe el Poder).
  10. If the power of attorney is written in a language other than Spanish, it must be translated by a Judicial Interpreter and duly legalized before the Attorney General's Office.
  11. Legible copies of both sides of the current identity card or passport of the principal and the attorney.

Indicate expressly:

  1. That the power of attorney grant power so that acting on their behalf and, on their behalf, as if they were themselves, the attorney must make all the necessary steps so that he may subscribe to AFP Siembra, the formal Benefit Request as appropriate. In the case of Survival applications, indicate that you can also carry out the procedures before the insurance company hired by the AFP.
  2. That the principal is authorized to present all the necessary documentation for such purposes, withdraw communications and sign any act or documentation that may be required by virtue of the necessary steps to execute the mandate granted, as well as granting a discharge receipt for the procedures, Information and communications received.
  3. For survival requests, they must indicate the name and general information of the deceased member.

NOTES:

  • Consular offices depending on the specific characteristics of each notarial act may request other requirements not numbered in this document.
  • Consular offices have the right to refuse to manage a service, if consular personnel doubt the utility to the citizen; if you think that such service may injure the future interests of the Applicant; or if you doubt the public faith of the Consular Office.
