{"id":31796,"date":"2018-10-31T02:11:32","date_gmt":"2018-10-31T02:11:32","guid":{"rendered":"https:\/\/consulatedrwest.gob.do\/?page_id=31796"},"modified":"2024-01-18T13:30:08","modified_gmt":"2024-01-18T13:30:08","slug":"poderes-notariales","status":"publish","type":"page","link":"https:\/\/consulatedrwest.gob.do\/en\/servicios\/poderes-notariales","title":{"rendered":"Powers of Attorney"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><div class=\"vc_row wpb_row vc_row-fluid mpc-row\"><div class=\"wpb_column vc_column_container vc_col-sm-12 mpc-column\" data-column-id=\"mpc_column-926a16243a97660\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\">\n\t<div class=\"wpb_text_column wpb_content_element\">\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">Power of Attorney is where a citizen (PROXY) or institution entrusts another citizen (PLAINTIFF) or institution to represent him before any civil act that may require before the institutions of the Dominican Republic or another country.<\/span><\/span><\/span><\/p>\n<p><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><b>REQUIREMENTS:<\/b><\/span><\/span><\/p>\n<ol type=\"a\">\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">Identity Documents of the PROXY (Current ID, Passport, Driver's License).<\/span><\/span><\/span><\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">Identity Documents of the PROXY (ID card, Passport, Driver's License).<\/span><\/span><\/span><\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">Draft of the POWER OF ATTORNEY (with the information as specific as possible of the object of the representation, that is to say all those actions that the PROXY requires that the PLAINTIFF performs on behalf of the PROXY). NOTARIZED BY A NOTARY NEAR THE RESIDENCE OF THE PURCHASER IN CASE OF NOT SUBMITTING THE PERMIT TO OUR HEADQUARTERS.<\/span><\/span><\/span><\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">Document that demonstrates that the POWER OF ATTORNEY has the legal capacity to ask the PLAINTIFF to do something in his \/her name in relation to any property, whether furnishing or state (title deed, bank account, financial certificate, etc.)<\/span><\/span><\/span><\/li>\n<\/ol>\n<p align=\"center\"><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\"><b>Special Power of Attorney <\/b><\/span><\/span><\/span><\/p>\n<ol>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">Original power of attorney (in Spanish language) signed by the beneficiary before a Notary Public of the place where the power is subscribed, and legalized before the Attorney General's Office.<\/span><\/span><\/span><\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">Include the Signatories Generals.<\/span><\/span><\/span><\/li>\n<li>Specify the benefit you are requesting:\n<ol style=\"list-style-type: lower-alpha;\">\n<li>Late Income by any of the following modalities: Pension for Life Annuity, Programmed Withdrawal or Return of Funds.<\/li>\n<li>Survival<\/li>\n<li>Disability.<\/li>\n<li>Terminal disease<\/li>\n<li>Old age.<\/li>\n<\/ol>\n<\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">Include place and date of subscription of the Power of Attorney. The date and place must coincide with the legalization of the Notary Public.<\/span><\/span><\/span><\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">Subscribe in the presence of two (2) witnesses, including their generals. Witnesses may not be relatives of the Plaintiff, Proxy, or the Notary Public. (*)<\/span><\/span><\/span><\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">The signatures of the Proxy, Plaintiff and witnesses, must be the same as that contained in the identity document of each person, and subscribe in blue ink.<\/span><\/span><\/span><\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">In the event that the Proxy cannot sign for his or her health condition, he or she must state their fingerprints. Said condition must be recorded in the power of attorney and attach an original medical certificate.<\/span><\/span><\/span><\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">The Power of Attorney must not have errors, cross-outs, modifications, omissions or side notes. <\/span><\/span><\/span><\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">All power subscribed outside the Dominican Republic must be <a href=\"https:\/\/mirex.gob.do\/apostillas-legalizaciones\/\">apostilled<\/a> in accordance with the Hague Convention or legalized at a Dominican Consulate and certified by the Ministry of Foreign Affairs (Chancellery). (Check the procedure of the country where the power of attorney is signed.)<\/span><\/span><\/span><\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">If the power of attorney is written in a language other than Spanish, it must be translated by a Judicial Interpreter and duly legalized before the Attorney General's Office.<\/span><\/span><\/span><\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">Legible copies of both sides of the current identity card or passport of the principal and the attorney.<\/span><\/span><\/span><\/li>\n<\/ol>\n<p align=\"justify\"><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\"><b>Indicate expressly:<\/b><\/span><\/span><\/span><\/p>\n<ol>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\"><span lang=\"es-DO\">That the power of attorney grant power so that acting on their behalf and, on their behalf, as if they were themselves, the attorney must make all the necessary steps so that he may subscribe to AFP Siembra, the formal Benefit Request as appropriate. We recommend using UPS or DHL.&nbsp;<\/span><\/span><\/li>\n<li><span style=\"color: #000000; font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: small;\">Please send the documents indicated above, together with a certified check or money order payable to the Dominican Consulate in California, to our address: 500 N.
